Mastering the Trademark Search
A trademark search is the single most important step in brand protection. 80% of rejections can be avoided with a thorough search.
1. Using the Public Search Portal
The IP India website provides a 'Public Search' tool. You can search by 'Wordmark', 'Phonetic', or 'Vienna Code'.
- Wordmark: Exact or partial string match.
- Phonetic: Search for names that sound similar (e.g., 'Klyne' and 'Kline').
2. Finding Your Class (The Class Finder)
There are 45 classes in the Nice Classification.
- Classes 1-34: Goods (e.g., Class 25 for clothes, Class 5 for pharma).
- Classes 35-45: Services (e.g., Class 35 for retail/ads, Class 42 for software).
3. Interpreting Search Results
- Identical: Exact match found in the same class. Move to a new name.
- Similar: Match found in a related class. Consult an attorney.
- Dead/Abandoned: These marks might be available, but check for 'Common Law Rights' first.
RegisterYourFirm Tip: Don't just search your own class. Search 'Related Classes' where your business might expand in the future.
