Trademarking Your Fashion Brand: The Class 25 Guide

In the fashion industry, your brand name and logo are your most valuable assets. Protecting them requires more than just checking one box on the application.

1. The Core Class: Class 25

Class 25 covers clothing, footwear, and headgear. This is the primary class for any apparel brand.

2. Don't Forget Related Classes

  • Class 35: Retailing and online store services. Essential if you have your own website or store.
  • Class 18: Leather goods, bags, and umbrellas.
  • Class 14: Jewellery and watches.
  • Class 3: Cosmetics and perfumes.

3. Protecting Your 'Label' vs 'Name'

You can register just the word (Word Mark) or the artistic design (Device Mark). For fashion, we recommend a Word Mark to protect the name regardless of how you style it on different collections.

4. International Protection

Fashion is global. Consider the Madrid Protocol if you plan to sell on international platforms like ASOS or Farfetch.

RegisterYourFirm Tip: Conduct a 'Logo Similarity Search' to ensure your brand's unique aesthetics don't infringe on existing luxury marks.
