How to Get 100% Income Tax Penalty Waiver Using Revised Form 161 Under the Income-tax Act, 2025

On 8 October 2026, the Central Board of Direct Taxes (CBDT) published Notification No. 134/2026 (G.S.R. 871(E)), officially notifying the Income-tax (Sixth Amendment) Rules, 2026.

This notification amends Rule 231 and introduces a completely restructured Form No. 161 for claiming immunity from penalties and prosecution under Section 440(2) of the Income-tax Act, 2025.

1. The Major Breakthrough: Settlement Now Available Even for "Misreporting"!

Under the old 1961 Act framework (Section 270AA / Form 68), immunity from penalty was strictly barred if the Assessing Officer marked the addition as "misreporting of income" (which carried a punitive 200% penalty). This forced taxpayers into decades of costly litigation.

Under Section 440(2) of the Income-tax Act, 2025 and the newly substituted Form No. 161, the CBDT has introduced a pragmatic path: taxpayers can now settle assessment disputes, extinguish penalties under Section 439, and gain immunity from criminal prosecution—even in misreporting cases—by paying a defined "Additional Income-Tax in Lieu of Penalty."

2. Payment Tiers Under Form No. 161

Nature of Assessment AdditionRequired Tax Payment Within Demand Notice WindowAdditional Income-Tax in Lieu of PenaltyAppeal Condition
Normal Under-Reporting of Income100% of Assessed Tax + InterestNIL (0%)Taxpayer must not file an appeal against the assessment order
Under-Reporting via Misreporting (Section 439(11)(a) to (f))Assessed Tax + Interest + Additional Tax100% of tax payable on under-reported incomeTaxpayer must not file an appeal (or must withdraw any pending appeal)
Specified High-Severity Misreporting (Section 439(11)(g))Assessed Tax + Interest + Additional Tax120% of tax payable on under-reported incomeTaxpayer must not file an appeal before Section 440(5) deadline

3. Step-by-Step Procedure to File Form No. 161

  1. Receive Assessment Order & Notice of Demand: Ensure you act within the statutory payment window (typically 30 days from receipt).
  2. Deposit Assessed Tax & Additional Tax: Pay the full demand along with the applicable Additional Income-Tax rate through the official e-filing portal.
  3. Submit Form No. 161 Electronically: Upload Form 161 through your e-filing portal dashboard, attaching challan receipts and an undertaking waiving the right of appeal.
  4. Receipt of Immunity Order: The Assessing Officer is statutorily mandated to pass an order granting immunity within one month of receiving Form 161.
