New Copyright Registration Portal & Mandatory IP India e-KYC Rules
October 2026 marked a major digital transformation for intellectual property administration in India.
On 16 October 2026, the Controller General of Patents, Designs and Trade Marks (CGPDTM) launched an all-new, unified Online Portal for Copyright Registration. This follows the strict enforcement of the 30 September 2026 mandatory e-KYC verification cutoff across all IP India digital accounts.
1. Features of the Revamped Copyright Portal (16 October 2026)
The new portal under copyright.gov.in fully modernizes the copyright filing workflow, aligning it with international WIPO standards:
- End-to-End Digital Processing for Form XIV & Form XV: Direct electronic filing for Form XIV (application for registration of artistic works, software code, literary pieces, sound recordings, and cinematograph films) and Form XV (amendments to the Copyright Register).
- Direct Digital Artwork & Code Uploads: Eliminates physical paper submissions for source code and design specimens. High-resolution digital files and PDF source code extracts can be uploaded directly.
- Seamless Payment & BharatKosh Integration: Real-time challan generation and instant payment receipts.
- Instant Diary Number & Discrepancy Tracking: Transparent status workflows with automated email alerts for examination discrepancies.
- Mandatory Profile Migration: Existing legacy users must complete a mandatory profile migration and password reset before lodging new applications.
2. The 30 September 2026 Mandatory IP India e-KYC Cutoff
Effective 30 September 2026 (11:59 PM), CGPDTM instituted an automated lockout across ipindiaonline.gov.in. Any account that failed to complete mandatory electronic Know Your Customer (e-KYC) verification has been restricted from:
- Filing Examination Replies (
MIS-R) - Lodging Notices of Opposition (
Form TM-O) - Applying for Trademark Renewals (
Form TM-R) - Joining virtual examination or opposition hearings
Verification Requirements:
- Natural Persons & Proprietors: Aadhaar-based OTP verification linked with PAN.
- Companies, LLPs & Attorneys: Class 3 Digital Signature Certificate (DSC) registered with the MCA/DGFT repository and matching the primary authorized signatory.
3. Why Software & Logo Creators Must Combine Trademark and Copyright
In the Indian legal ecosystem, high-growth startups frequently make the mistake of securing only a trademark or only a copyright. Maximizing intellectual property protection requires dual-layer security:
| Asset Layer | Trademark Protection (Nice Class) | Copyright Protection (Artistic/Literary Work) |
|---|---|---|
| Brand Name / Wordmark | Protects commercial use in commerce across designated goods/services | N/A (single words cannot be copyrighted) |
| Logo Design / Graphical Device | Prevents confusingly similar brand marks in the market | Protects unique artistic expression worldwide under the Berne Convention |
| Software Source Code & UI | Trademark protects the software product name | Copyright protects underlying proprietary source code and architecture |
| Term of Protection | 10 years (renewable indefinitely) | Lifetime of author + 60 years |
