Hassle-Free GST Registration in 7 Days & Strict Curbs on Fraud Notices (Circulars 257 & 258)
On 26 October 2026, the CBIC issued two landmark circulars that address two of the biggest pain points for entrepreneurs and tax professionals: Circular No. 257/03/2026-GST and Circular No. 258/04/2026-GST.
Together, they establish a binding taxpayer protection charter that ends arbitrary registration queries and curbs speculative fraud notices.
1. Circular 257/03/2026-GST: The 51-FAQ GST Registration Charter
For years, honest founders setting up startups from residential flats or home offices faced groundless rejections in FORM GST REG-03. Circular 257 strictly prohibits proper officers from raising frivolous queries:
What Officers CANNOT Demand or Reject:
- Residential Premises & Domestic Electricity Bills: Officers cannot reject an application or question an applicant merely because the business premises is a residential house or the electricity bill reflects a domestic/residential tariff.
- Out-of-State Director / Partner Residence: An application cannot be held up simply because the directors, partners, or proprietor reside in another State or city.
- Non-Mandatory Licenses (Udyam, Shop Act, Trade License): Officers cannot demand municipal trade licenses, labor registrations, or pollution NOCs not prescribed under
FORM GST REG-01. - Mandatory 7-Day Approval SLA: For Aadhaar-authenticated applicants, applications must be approved within 7 working days (3 working days under expedited Rule 14A).
The Exhaustive Document Checklist Prescribed by CBIC:
- For Owned Premises: Exactly 1 document (Electricity bill, property tax receipt, or municipal khata copy).
- For Rented / Shared / Family-Owned Premises: Exactly 2 documents (Valid Rent Agreement / NOC from owner + owner's electricity bill or property tax receipt).
2. Circular 258/04/2026-GST: Strict Discipline on Show Cause Notices & Fraud Allegations
Circular 258 reins in aggressive field officers who routinely invoke the 5-year extended limitation period and 100% fraud penalties under Section 74 / Section 74A(5)(ii):
- Positive Evidence Required for Fraud Allegations: Officers cannot mechanically allege fraud or willful suppression for routine reconciliation differences (such as GSTR-1 vs. GSTR-3B or GSTR-2B mismatches). The SCN must plead and append concrete proof of deliberate intent to evade tax.
- Mandatory Personal Hearing (Section 75(4)): No adverse order can be passed without scheduling a formal personal hearing—even if the taxpayer omitted to check the hearing box in their reply.
- No Adjudication Beyond the SCN (Section 75(7)): Assessing authorities are strictly forbidden from confirming demands on grounds, sections, or theories not explicitly stated in the original SCN.
- Mandatory Human Audit of Officer AI Tools: Departmental officers cannot copy-paste automated algorithmic flags into notices. The officer must independently review the taxpayer's filed records before issuing an SCN.
3. Practical Steps If You Receive an Unfair Notice
If a GST registration application is delayed with a query for commercial electricity bills, or if you receive a Section 74 notice without evidence of fraud, submit a formal response citing:
